TERMS & CONDITIONS

1. Introduction

These Terms and Conditions ("Agreement") govern the provision of remodeling services by Rick Renovations LLC ("we," "us," "our," or "the company") to the client ("you" or "your"). By engaging our services, you agree to comply with and be bound by the following terms and conditions.

2. Warranty

Rick Renovations LLC warrants that all work performed will be of professional quality and in accordance with industry standards. This warranty is valid for a period of one year from the date of completion. This warranty does not cover normal wear and tear, misuse, or damage caused by external factors beyond our control.

3. Payment

Payment terms are as follows:

  • An initial deposit may be required upon signing this Agreement.

  • Progress payments will be due at specified milestones, as detailed in the project schedule.

  • Final payment is due upon completion of the work. Late payments are subject to a late fee of [10%] per month, or as applicable by state and or county laws.

 

4. Indemnification

We are liable for the actions of our agents, employees, partners, or subcontractors and we shall fully indemnify, defend, and hold the customer harmless from suits, actions, damages, and costs of every name and description (excluding attorney's fees) arising from or relating to personal injury and damage to real or personal tangible property alleged to be caused in whole or in part by the company, contractor, its agents, employees, partners, or subcontractors, provided, however, that the company shall not indemnify for that portion of any loss or damages proximately caused by the negligent act or omission of the state, the city, or the customer.

You agree to indemnify, defend, and hold harmless Rick Renovations LLC, its officers, employees, agents and contractors from any and all claims, damages, losses, liabilities, and expenses arising out of or related to your breach of this Agreement, your negligence, or your use of our services.

You agree to indemnify, defend, and hold harmless Rick Renovations LLC, its officers, employees, agents, and contractors from any and all claims, damages, losses, liabilities, and expenses arising from the use of media (such as photographs or videos) taken from job sites. This agreement holds as long as the media does not contain any personal information and does not infringe on any trademark, copyright, patent, trade secret, or other intellectual property right. You must inform us in writing of any specific content that cannot be used due to such restrictions prior to the commencement of the project.

5. Permits and Approvals

All necessary permits and approvals required for the project must be provided by the client before the start of the job. You agree to provide reasonable assistance and access to your property as needed to secure and complete these permits.

6. Date of Completion

We will use reasonable efforts to complete the project by the estimated completion date. However, we are not responsible for delays caused by factors beyond our control, including but not limited to weather, unforeseen site conditions, or changes to the scope of work.

7. Insurance

Rick Renovations LLC carries general liability and workers' compensation insurance. Proof of insurance can be provided upon request.

9. Dispute Resolution

Any disputes arising out of or relating to this Agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Each party will bear its own costs and attorney's fees.

10. Liens and Waivers of Liens

Upon receipt of final payment, Rick Renovations LLC will provide a waiver of liens for the completed work. You agree not to withhold any payments due to the presence of any liens or claims by subcontractors, suppliers, or other parties.

11. Scope of Work

The scope of work includes all tasks and responsibilities outlined in the project proposal and any agreed-upon change orders. Any work not specified in the scope of work will be considered additional and may result in additional charges.

12. Work Description

Rick Renovations LLC will perform the remodeling work described in the project proposal. All work will be completed in a professional and workmanlike manner.

13. Change Orders

You may request changes to the scope of work by email, in person, or by mail. Any other request method will not be considered official. 

 

Any changes to the scope of work must be documented in a written change order and signed by both parties. We will review the request and provide a written change order detailing any adjustments to the cost and timeline. Change orders may result in additional charges and/or changes to the project timeline.

14. Cost Estimate

The cost estimate provided in the project proposal is based on the initial scope of work. Any changes to the scope of work, unforeseen conditions, or additional requirements may result in a revised cost estimate.

15. Job site

You agree to be present to provide access to the job site during the agreed upon time frame, you ensure that the site is safe and free of hazards, and you agree to provide any other necessary support to facilitate the completion of the project. You are responsible for securing personal property and valuables at the job site, including children and pets.

17. Lead Paint Testing and Abatement

You are responsible for informing us if you are aware of the property having lead or if the structure was build before 1978. If the project involves work on a structure built before 1978, Rick Renovations LLC will conduct lead paint testing and, if necessary, abatement in accordance with federal and state regulations.

18. Quality Standards

All work will be performed in accordance with industry standards and best practices. Materials and products used will be of good quality and suitable for the intended purpose.

19. Who Will Do What?

Rick Renovations LLC will provide all labor, materials, equipment, and supervision necessary to complete the project. In instances where part of the work is subcontracted to another company or person, we will ensure that all subcontractors meet our quality standards and are properly licensed and insured. Any change requests must only be directed to us, and not subcontractors.

20. Additional Terms and Conditions

Rick Renovations LLC provides many services and the abovementioned Terms and Conditions are the minimum for the industry. Additional Terms and Conditions may be added on a project-by-project basis and detailed within the Project Plan. Agreeing to either of the terms and conditions implies the acceptance of the other terms and conditions, as long as the one accepted is the newest.
